By accessing or using sporge.dev ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These Terms apply to all users, including free and paid subscribers.

Sporge is an AI-powered pixel art asset generator. Users submit text descriptions and receive 32x32 pixel art PNG files with transparent backgrounds, suitable for use in 2D game development. The Service is provided as-is, and AI-generated output may vary in quality.

To access the Service, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at hello@sporge.dev

You must be at least 13 years of age to create an account.

Sporge offers a free tier with a limited number of lifetime generations. Paid subscription plans provide higher monthly generation limits. By subscribing to a paid plan, you agree to:

• Pay the applicable subscription fee in advance each billing cycle
• Provide accurate billing information to our payment processor (Stripe)
• Unused generations do not roll over to the next billing period
• Cancellations take effect at the end of the current billing period

Sporge reserves the right to modify pricing with 30 days notice to existing subscribers.

Due to the nature of AI-generated content and the consumption of computational resources, Sporge does not offer refunds on used generations or partial billing periods. If you experience a technical failure that prevents generation, contact hello@sporge.dev and we will assess the situation on a case-by-case basis.

Assets generated by Sporge using your prompts belong to you. You are granted full ownership of the output PNG files, including the right to use them in commercial game projects without royalties or attribution requirements.

You may not claim ownership of the Sporge platform, its underlying AI systems, system prompts, or generation infrastructure. The Sporge name, logo, and branding are trademarks of the operator.

You are responsible for the content of prompts you submit. You agree not to submit prompts that:

• Contain hate speech, harassment, or content targeting individuals
• Attempt to generate content depicting minors in harmful contexts
• Are designed to circumvent the Service's intended use
• Infringe on third-party intellectual property rights
• Are submitted through automated scripts or bulk tools without prior written permission

Sporge reserves the right to suspend accounts that violate these guidelines without refund.

Sporge uses third-party AI services (Anthropic API) to process your prompts and generate output. We do not guarantee:

• The accuracy, quality, or consistency of generated assets
• That generated assets will match your description exactly
• Continuous or uninterrupted availability of the AI generation service

Your prompts are processed by Anthropic's API. By using Sporge, you acknowledge that prompt data is transmitted to Anthropic for processing. Please review Anthropic's usage policies at anthropic.com.

To the fullest extent permitted by law, Sporge and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to: loss of revenue, loss of data, or costs of substitute services.

Our total liability for any claim arising from use of the Service shall not exceed the amount you paid to Sporge in the 3 months preceding the claim.

Sporge is operated by a small team and does not guarantee any specific uptime SLA. We will make reasonable efforts to maintain availability but may experience downtime for maintenance, updates, or circumstances beyond our control. No compensation is provided for service interruptions.

You may delete your account at any time through the account settings page. Sporge may suspend or terminate accounts that violate these Terms, engage in abuse, or for any other reason at our discretion, with or without prior notice. Upon termination, your access to generated assets stored on our servers may be lost.

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before any formal proceedings. For questions or disputes, contact hello@sporge.dev.

We may update these Terms from time to time. We will notify users of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
